WE DON'T GIVE UP!

In June 2016 Cavendish took assignment of a trade debt of c£35,000. The insolvency practitioners and their lawyers had been chasing the debt since July 2014. The debtor refused to meet with the liquidators and would not acknowledge the debt unless signed delivery notes could be provided. After initially trying to engage with the debtor Cavendish issued a Statutory Demand . The debtor successfully applied to have the Statutory Demand set aside claiming that the debt had been paid. A claim was issued in January 2017 and a nebulous Defence and Counterclaim was issued in February 2017. Two Part 18 requests and unless orders were served to obtain the information needed to understand the defence and counterclaim. On the 7 November 2019 the case was heard in the County Court and the Judge found overwhelmingly in favour of Cavendish. It has taken nearly three and a half years for Cavendish to win this case for the benefit of the creditors.
